Information for consumers

Pursuant to Act no. 634/1992 Coll., on consumer protection, as amended, a consumer has the right to out-of-court settlement of a consumer dispute arising from a contract for the provision of legal services. The competent entity for out-of-court settlement of consumer disputes between a lawyer and a consumer arising from contracts for the provision of legal services is the Czech Bar Association, based at Národní 16, 110 00 Prague 1. Personal data protection
1. INTERPRETATION OF TERMS

The Data Controller of the Client's personal data is Jašíček & Partners s.r.o., advokátní kancelář, ID No.: 241 57848, having its registered office at Prague 1– Nové Město, Vladislavova 1390/17, Postcode 110 00, a company entered in the Commercial Register maintained at the Metropolitan Court in Prague, file C 183971 ("Attorney").

The legal basis for the processing of the Client's personal data is the agreement for the provision of legal services concluded between the Client and the Attorney (the "Agreement"), through which the Client mandatorily provides the Attorney with his personal data.

The purpose of this document is to inform the Client about the processing of his personal data by the Attorney within the meaning of Articles 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) and Act No. 110/2019 Coll., on the processing of personal data, as amended.

2. PURPOSE OF PROCESSING

The Attorney processes the Client's personal data for the purpose of implementing the Agreement concluded with the Client, in particular for the purpose of providing legal advice, fulfilling the requirements and instructions given by the Client.

3. RECIPIENTS OF PERSONAL DATA

Recipients of the Client's personal data are (i) public authorities (e.g. courts, administrative authorities) (ii) providers of information system maintenance, (iii) cooperating attorneys involved in providing legal advice to the Client, (iv) tax and accounting advisors, auditors, experts, (v) translators and translation agencies, (vi) providers of postal and courier services, and other recipients according to the needs and instructions of the Client, to the extent resulting from the specific need for the provision of legal services.

4. PERIOD OF PROCESSING OF PERSONAL DATA

The personal data will be processed for the duration of the contractual relationship under the Agreement and after its termination will be handled in accordance with the applicable legislation, in particular Act No. 85/1996 Coll., the Act on Advocacy, Act No. 499/2004 Coll., on Archiving and File Service and on Amendments to Certain Acts, Act No. 110/2019 Coll, on the processing of personal data and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

5. CLIENT RIGHTS
5.1. Right of access to personal data

The client has the right to obtain information from the Controller - the Attorney about whether the Controller processes his personal data and, if so, what the data is and how it is processed.

5.2. Right to rectification and completion of personal data

The Client also has the right to have the Controller - the Attorney correct inaccurate personal data concerning him without undue delay upon his request. The Client has the right to complete incomplete personal data at any time.

5.3. Right to erasure of personal data

The Controller - the Attorney is obliged to destroy the personal data that he processes about the Client if the legal conditions are met and the Client requests it.

5.4. Right to restriction of processing of personal data and the right to object

The Client has the right to have the Controller - Attorney restrict the processing of their personal data in certain cases. The Client has the right to object at any time to processing that is based on the legitimate interests of the Controller - Attorney, a third party or is necessary for the performance of a task carried out in the public interest or in the exercise of official authority.

5.5. Right to data portability

The right to data portability gives the Client the possibility to obtain the personal data he has provided to the Controller - Attorney, in a common and machine-readable format. It may subsequently transfer this data to another Controller or, if technically feasible, request that the controllers transfer it between themselves.

5.6. Right to lodge a complaint about the processing of personal data

In the event that the Client is in any way dissatisfied with the processing of his personal data carried out by the Controller - Attorney, in particular if he believes that his right to personal data protection has been violated and that there is unauthorized processing of his personal data, he has the right to ask the Attorney for an explanation or has the right to file a complaint with the Office for Personal Data Protection, ID No: 708 37 627, with registered office at Prague 7, Pplk. Sochora 27, Postcode 170 00.

5.7. Non-exercise of the right to withdraw consent to the processing of personal data

The right to withdraw consent to the processing of personal data at any time does not apply in this case, as the Client's personal data is processed on the basis of the performance of the Agreement concluded with the Client, not on the basis of the consent to the processing of personal data.
